As Phil Marti stated, the employer is responsible. An old
saying in management circles is that one can assign
authority but not responsibility.

Not in my book. The requirement is not on the payroll
clerk, it's on the employer. If the employer chooses to
assign the responsibility to someone who won't carry through
on it, the employer owes the penalty.

Recently IRS denied my request to abate penalties on late
deposit of payroll taxes. My predecessor had delayed
payments by couple of days in his/her own wisdom, I would
like to file an appeal before Appeals officer to consider
abatement. The delayed payments were because of incompetence
of my predecessor. Is this a reasonable cause to get penalty
abatements?

1. Does anyone have experience in handling appeal matters
and is it worth doing it in the first place?

2. Does anyone have a letter or template I can use to
protest IRS penalties before the appeals officer.

Any inputs pertaining above will be appreciated.
