No. You can file an amended return for 2002.

Unless, perhaps you had negative taxable income last year,
you need to amend last year's return.

NO. You have to amend your 2002 tax return. Didn't you read
the Schedule D, Line 18 instructions? Did you fill out a
2002 Capital Loss Carryover Worksheet?

You need to go back and amend the 2002 return to show the
sale on Schedule D. The loss will then be used on your 2002
return, resulting in a refund, or carried forward to your
2003 return, depending on what other items are on the
return.

You can file an amended return for 2002, and they'll send
you a refund for the excess tax you paid.
