You're the classic "abandoned spouse" with children and can
file as head of household.

For the rest - either a divorce attorney or the police.......

You can file "head of Household" if your supported your 2
children. Seek guidance of an attorney right away on
marital status.

Sounds as if you've taken the right steps to determine your
status. As far as taxes are concerned, I would ask the
attorney you've contacted to give you a written advice as to
how you should file your taxes -- and depend on that. You
don't have to send it in with your return ... simply keep it
with your records in case any inquiries come your way, so
you can submit a copy in support of your tax filing.

I would say you should file as Head of Household since you
have the children and your wife did not live with you the
last six months of the year. You, I assume, provided more
than half the cost of the home where you and the children
live.

It sounds like you fall under the "considered unmarried"
provisions which will allow you to file as Head of
Household. See Publication 501.

BS. My question is since I'm not 100% sure what the hell my
marital status is, how do I file? In the meantime I've went

lawyer to find out if I am indeed divorced or if she
commited bigamy by getting remarried.
