| No. If you gave her more than $11,000, you will are supposed to file a gift return and pay a gift tax on the extra. Unlikely the gov would detect this unless you paid out in large chunks. << -------------------------------------------------> << The Charter and the Guidelines for submitting > << messages to this newsgroup are at www.asktax.org > << -------------------------------------------------> |

For example, it is my understanding that here in NC, this relationship is illegal (though not enforced) and therefore you cannot claim you live-in girlfriend as a dependent. bex << -------------------------------------------------> << The Charter and the Guidelines for submitting > << messages to this newsgroup are at www.asktax.org > << -------------------------------------------------> |

My > question is can I claim her as dependent on my tax return? > If not, what is/are other way of claiming her for some > return? tax return. There are five tests, which must be met: 1. The dependent must have gross income less than the exemption amount ($3,050 in 2003) 2. You must provide over 1/2 of the dependent's support for the year. 3. The dependent must be a certain type of relative. If not a relative, the dependent must live in the taxpayer's home. 4. The dependent must not have filed a joint return. 5. The dependent must be a citizen, national or resident of the US, or a resident of Canada or Mexico. As you can see, the "dependent" in question does not meet test #1 and test #3. ***The information provided in this post is provided for educational purposes only with the understanding that the author is not herein engaged in rendering legal, accounting, tax, or other professional advice and services. *** << -------------------------------------------------> << The Charter and the Guidelines for submitting > << messages to this newsgroup are at www.asktax.org > << -------------------------------------------------> |
