If you can claim an exemption for your sister as a
dependent, then she would qualify you to file as head of
household. But, remember, if her husband had income and
filed a joint tax return, she would not qualify as your
dependent.

The qualifiers to file as H of H are:

1. You must be unmarried.

2. You must have paid more than half the cost of keeping up
a home for the year.

3. A qualifying person must have lived with you in the
home for more than half the year. [A sister is listed
as one of the qualifiers.]

For 2001 no, assuming that "late" means after 7/1. For 2002
only if at least one of them qualifies as your dependent.

You might pass this anecdote along to your mother. A friend
decided to marry her longtime live-in. This was announced
over dinner when her mother was visiting. After dinner Mom
and I were chatting. Mom: "My friends used to say,
'Doesn't it break your heart that she's living in sin?'
Sure, but I should lose my daughter over it?"

I am 32 years old, never been married, and own a reasonably
large home with an in-law apartment. My sister, her husband,
and my two nephews have been living with me since late 2001.
They do not pay rent, but I bust his butt to take care stuff
I use to pay people to do. They do pay for their food and
utilities. Am I a Head of Household for 2002? How about
2001?

Also since they have been living with me, my mother who
dislikes my brother-in-law will not come over, but she
harranges me for giving them a place to live. Can I get
a deduction for listening to her crap or do I have to pay
extra taxes for not having her being here for two weeks at
a time (only joking).
