The exception being if the wages come from a sheltered
workshop, e.g. Goodwill. Age then doesnt' matter, nor
wages, as long as of course other tests are met.

While there is a gross income test that also must be passed,
where is the medical reason to claim a dependency exemption
found?

Please say more about this exception for disabled?

Are you referring to sheltered workshop income?

But perhaps you are asking the wrong question. I
suspect you really want to know: when can you assume
that you are not being claimed as a dependent and,
therefore, you must file your own tax return if you
meet the other requirements?

The answer, again, is the Dependency Tests in IRS Pub
17. If you "fail" any one of the tests (that is, you
should not be claimed as a dependent), you can go ahead
and file your own tax return. If your parents (or
whoever) also claim you as a dependent, that is their
mistake, not yours.

But again, the best answer for both of you is for you
to ask them first and to reach the right decision
together.

Since you are over 24, there is no way your parents could
claim you if you had gross income over $3,050.

See Publication 17 at the IRS website, www.irs.gov. Chapter
3 details the tests for dependency.

Age is NOT a Dependency test by itself, however it is a
factor in one of the tests.

The short answer is that you are claimable as a dependent if
you pass all the tests relative to a given TaxPayer. Most
people are not claimable as dependents because of gross
income (if you made more than $3050 in 2003) or because of
support (the Taxpayer who wants to claim you must provide
over 50% of your support).

Ask your parents!!!!!!! If you are 25 more than likley
you can't be claimed by anyone else if you are working.

If you are over 24 years old and have taxable income greater
than $3,050 (in 2003) then NOBODY else can claim you as
their dependent -regardless of the amount of support
provided. There is an exception for someone who is disabled.

First, you can ask your parents. They shouldn't be claiming
since you were 25 in 2003.

Normally, one cannot be claimed as a dependent once they
reach age 19 (24 if a student living with or supported
primarily by their parents) by the end of the tax year.

However, there are exceptions: children with a disability,
anyone who is a member of household or meets the
relationship test (even parents who live elsewhere,
including Canada or Mexico) ... so this does not have a
simple, ironclad description. However, with the parameters
cited above, plus an income in excess of $3,050, the vast
majority of people cannot be claimed as dependents.

Every 1040 Instruction book offers a simplified description
of the five tests used to determine whether someone is a
dependent. But, as noted above, there is more to it.

For a full description, you can read Chapter 3 in Pub 17.

Your parents, or anyone else for that matter, can only claim
you as a dependent if they are providing for over 50% of
your support(living expenses). If you are providing your
own home and food, the odds are they are not providing over
50% of your support and cannot legally claim you as a
dependent.
