about his mother's name.

Turns out his mother and I grew up together, same home town,
and were "great" friends in the 8th and 9th grades!,

Thanks to all for answering my questions. I sent my crf-002
to the Ga. Dept of revenue yesterday to get a tax ID. Good
point about using the tax ID to keep from paying tax on
stock purchases.

If you make sales to any state in which you do not have
"nexus", that means an office or presence in the state other
than Georgia, then you do not have to charge any sales tax.
So you're right.

As for Georgia, do contact your local department of revenue.
Do they have one in Lagrange?

And is your mother's name "Marcia"? if so, contact me at

Yes, you must register as a seller with the Georgia
Department of Revenue and collect sales or use taxes on all
of your sales of taxable property that are shipped or
delivered to addresses in Georgia. If the merchandise is
shipped from GA to GA, it's sales tax. If it's from outside
GA, e.g. from a supplier out of state, to GA, it's use tax.
But either way, you are responsible to collect it and pay it
over to the state.

Contrary to popular belief, and what you may very well have
read inthe newspaper, there is NO exemption from sales or
use tax for purchases/sales over the Internet. All such
sales are subject either to sales tax (if buyer and seller
are located in the same state) or use tax (if they are
located in different states) -- unless, of course, the state
has no sales or use tax (NH, OR, MT, AK, DE). If the seller
has a physical presence in the buyer's state, the seller can
be required to collect and pay over the use tax to the
buyer's state. Otherwise, the tax is the buyer's
responsibility.

Yes. Any sale to a Georgia customer (generally based on the
shipping address, or the customers billing address) are
taxable Georgia sales.

You need a sales tax number (CRF-002), if you have employees
(or are a corporation) you'll need an FEIN, and for
employees, a state withholding number, and a state
unemployment number. You'll need the sales tax number to
buy your products sales-tax free.

You are correct that sales to out-of-state customers are
exempt from Georgia sales tax.

Depending on your needs, you probably have other accounting
and/or tax questions.

I have an Internet storefront at GhostForce.com selling
clothing, test equipment, misc. products, I believe I can
sell out of state on the web without sales tax. My question
is do I have to charge sales tax for internet customers that
live in Georgia? I'm going to an accountant in the next
week. What questions should I ask? I have a city business
license, they told me to go through the Georgia Dept. of
State to figure out sales tax. What are the laws? How do I
stay legal with an online business?
