hmmm... lawyer time.

My neighborhood has been granted historical status and a
neighbor who I don't know donated an easement. I think I
will hold onto this idea until I end up with a killer tax
bill- like inheritance- and then use it to reduce that. I
don't have a particular need for that at this time.

thanks,

Don

Read IRC Section 170(f) carefully. Then note all the
private letter rulings and such that let taxpayers get away
with pushing the limits of this and all the Tax Court cases
that slap taxpayers silly even when their situations are
practically identical to those described in the PLRs (except
that they weren't the taxpayer named therein), yet the Court
denies the deduction.

One suggestion: If the property doesn't have historical
status with the government (federal, state, or local, as
appropriate to its historical claim), I wouldn't even try it
until such status had been granted. [I'm familiar with that
because about 7 of my neighbors have a locally granted
status because of the architect who designed their houses.]

Yeah, I've worked on them in the past, though not for
several years. What do you want to know about it?

You'll find information about how to value a charitable
donation of an easement on page 7 of IRS Publication 561.

Default Easement Donations in historic districts

Is anyone familiar with the concept of donating an easement
to a historic trust to keep the facade of a property
historically accurate?
