I suppose this depends on the details of the Employee Stock
Purchase Plan, although I've never heard of such a clause
before. Once you purchase the stock, it's yours (you're not
talking about stock *options*, are you?).

Anyway, this doesn't seem to be a tax-related question. Try
asking in misc.invest.

Default boughten stock from where I work

If i were to buy stock from where i work and have this job
for at least a year then leave for another job, can the
company that I worked for take away my stock even if I do
not sell it.
