You won't need an FEIN for the business unless you are going
to have employees. You won't need a state number unless you
have employees OR sell tangible personal property or
services that are subject to sales tax in New York.

If you are selling tangible personal property, you must
register as a seller with the NY Department of Revenue, and
collect and pay over sales or use tax on any sales shipped
to addresses in New York State. (It's sales tax if the
property is shipped from New York; it's use tax if it is
drop shipped from outside the state, by a related or
unrelated supplier.) You are not responsible for collecting or paying
sales or use tax to any other state unless you have a physical
presence there. A physical presence would include inventory that you
own that is located in the state.

You should contact the NY DOR before you start doing
business and make sure that you are in compliance with state
tax laws. If your business does not require registration as
a seller, they will tell you that.

Disclaimer -- I've never earned money within 1000 miles of
NY, so they haven't decided I own them taxes -- yet.

From the looks of this business, you don't need a federal
EIN unless you have employees or a pension plan. In
California, also known for taxing anyone who can spell
"Kalifornia" (close enough), you wouldn't need a state
employer ID, but you would need a sales tax ID.

Default nys new e-commerce business tax info

I have just started a web business in new york state,but i
have a few questions. This is a sole propritorship. Do i
need a federal ein # and a seperate nys # for my business?
Are their any other laws on e-commerce selling that i shoud
be aware of? I am aware of my personal state tax # which is
my ssn.
