Thanks, 1041 and 56 were the two forms I was trying to think
of. After looking at the forms, I will hire someone to fill
out the 1041. Too many traps to fall into trying to get it
right.

That should take care of it. (I'm assuming the attorney is
dealing with the need for a 1041 estate income tax return,
if any.)

Does "estate tax forms" include the 1041 (estate INCOME TAX
form) and Kansas equivalent? If not, you need someone to
take care of THAT. (If the attorney doesn't know about
those, you need another attorney.) It's possible that such
forms are not required, but the atorney needs to be aware of
the possibility.

At the very least, "estate tax forms" should include getting
an EIN for the estate, filing form 56 to inform the IRS who
the personal representative of the estate is, form 706
estate tax return (in the event that the total value of the
estate plus all of your father's unexcluded (reportatble,
whether or not reported, exceeds $1,000,000), any Kansas
estate or inheritance tax returns required, and the 1041 and
(probably) K41.

"Your father" (his estate, actually) has to file any income
tax returns which he would otherwise be required to file,
with the usual April 15 due date.

The beneficiary will have to report any income passed
through the estate (probably on 1041 schedule K-1) on his
1040 Schedule E.

If the decedent was not married, there is no "survivor" per
se. A PERSONAL REPRESENTATIVE or EXECUTOR needs to be
appointed, and that person is responsible for making sure a
final 1040 is filed for the decedent, including all income
up to the date of death.

I have engaged an attorney to handle the estate tax forms
for my father but he doesn't do normal taxes. What forms are
required to be filled out by the survivor of an individual
from Kansas other than 1040 and K40. He was not married and
had negligible income out side his IRA.
