OK, that worked. IRS should have explained this when they
threw back my first 1040 submission. Instead they just
attached standard response form with "1040NR required"
checked.

Thanks!

Assuming that you are dual status because you ARRIVED in the
US during this year, then you only need to file form 1040
for the resident period. Mark the return "Dual Status
Return" at the top of page 1. To that return attach a
statement indicating when you arrived in the US and that you
had no US source income in the nonresident period.

IRS Pub 519 starting on page 28 (2002 version) explains how you
figure your tax and complete your returns. There is also an
example. Basically, if you are a resident alien at the end of the
year, you file the 1040 marked a a dual status return on the top
of the first page, and attach a statement that contains your
income as a nonresident. You can use the 1040NR for this purpose
rather than a statement. If you had no effectively connected
income nor any not effectively connected income while a
nonresident, then the easiest thing to do is to just attach a
statement that states just that.
IRS Pub 519 is at:
http://www.irs.gov/formspubs/page/0,,id=11849,00.html or you can
download a copy at:
http://www.irs.gov/pub/irs-pdf/p519.pdf

Default 1040NR - how to fill when no income?

I'm dual-status alien (first year), and as such have to
file both 1040 and 1040NR. Everything's dandy with 1040, but
I'm lost as to how to fill out 1040NR when I had no US
source income during non-resident part of the year? I've
called IRS, and they didn't know and promised to get back to
me... I suspect this can take a while. I've also studied
1040NR instructions and cannot find what I'm looking for.
Heeelp!

TIA,
Peter
