Almost all legitimate claims are paid; if a questionable claim (not the case here), IRS will select for audit on at least the claim issue. It is thus rare to select an allowable claim, but to first examine other issues on the return. True, the brokerage company may have been at fault initially, but in their monthly statements to you, you were put on notice when that withholding occured. The money has long since been sent to the government. The beoker doesn;t have it, and you can easily get it by amending. So the thing to do now is to amend. You might also ask why didn't the IRS credit your account with the withholding sent to your account by the broker?
