....And it took you this long to notice? File an amended
return by April 15, 2006 to claim your refund. There is
no shortcut.

The easiest is a simple 1040X; why not prefer to do so?
Fear of audit? Almost all legitimate claims are paid; if a
questionable claim (not the case here), IRS will select for
audit on at least the claim issue. It is thus rare to
select an allowable claim, but to first examine other issues
on the return. For some years at IRS, I managed this
particular area; nothing to worry about unless something
pretty weird on the original return.

No, you've definitely come to the right forum.

An amended return is the only way to go by this time. True,
the brokerage company may have been at fault initially, but in
their monthly statements to you, you were put on notice when
that withholding occured.

You didn't throw them away, did you?

You never did tell us how the broker came to withhold from
you in the first place. What sort of account is this? That
could affect my reply.

But what would you expect the broker to do now? The money
has long since been sent to the government. The beoker
doesn;t have it, and you can easily get it by amending.

So the thing to do now is to amend.

You might also ask why didn't the IRS credit your account
with the withholding sent to your account by the broker?

In fact, that would be an excellent question to ask.

Default Excess 2002 withholdings

I just discovered that my stock brokerage withheld tax from
an early 2002 transaction. This occurred in spite of very
explicit written instructions that I no longer wanted any
tax withheld. In 2001, I had asked them to withhold tax
since I had inadequate employment based withholdings. The
stop withholding instructions were sent to them about 10
days earlier and they have acknowledged receiving them.
Unfortunately, I did not claim those withholdings.

I realize that I can submit an amended return but naturally
I'd prefer not to. Is there anything that the brokerage
company could do for me so that I would not have to submit
an amended return?

Is there another newsgroup that gets more into tax law etc.
that I should post to? I have sent the IRS an e-mail asking
their opinion.
