| John and Mary are married. John dies. Mary files married joint with John (as surviving spouse) for that year. If Mary remarries (to David), she and David can file married joint but John's return has to be married separate. "In the case of remarriage, you have a few filing options.> surviving spouse remarries be the end of the year in which > the decedent died? Please email me if you do. ASAP thank > you. Your decision depends on several things, including the incomes of your current and late spouse. By remarrying, you forego the right to file jointly with your deceased spouse. Someone will then need to file a "married filing separately" return for the decedent. If you are a surviving spouse with zero income, the executor filing your deceased spouse's return and your new spouse may both be able to claim you as an exemption." http://moneycentral.msn.com/articles...vents/5974.asp "Jack" - John H.
