They have repeatedly told us, but never put in writing (?!?!), that being deployed does not entitle the spouse at home to use HofH. Sort of like the student being away, but still at home for tax purposes - gone but not forgotten. | In another thread we are talking about possible hoh status for those married but living apart ALL of last half of the year. D Stussy brought up an interesting possibility, and as borne out by the last reponse by the OP (original poster), he must be clairvoyant! lol So, I got to thinking about it further. Down here we have a military installation called Ft Benning; maybe some have heard of it. people come and go all the time, either permanantly transferred or sent away on what's called 'TDY' (temperorary duty), or even sent away to war, (like the Third brigade of the Third Infantry Division). So..... the spouse is sent to war and is away from home all six last months of the year. Main home is here near Ft Benning, but he or she does not live with spouse at any time. If spouse also works, she should then be able to file hoh, and other spouse in Iraq files MFS. OR, would IRS consider that 11 months temporary? I've never had it come up before, and I have had military clients. One caveat though, if the military member is supposed to be gone from June through December, don't he DARE think about R & R unless he meets his SO somewhere other than their home. Poor kids, don't get to see their dad/mom.
