I think I finally got it resolved, but it still doesn't make
much sense. They told me we should not have filed the 2002
return (it had $12,000 applied from the original 2001
return) before filing the amended 2001. Most other
jurisdictions seem to have no problem keeping them separate.

Instead of just assessing additional tax and interest for
the additional income we were reporting, they took back the
$12,000 applied then recalculated the amount to apply to
2002. I can only assume the difference between the $12,000
and the new amount of $11,741.35 is interest on $1,527. I
couldn't get a straight answer out of the person over the
phone. He just told me we'd spent enough time over this and
I should go over the numbers. The interest rate he quoted
me, though, does not match the rate listed in the D-40
instructions. Unless he was including the penalty as well
(quoted 18% vs. 13% interest & 5% penalty).

I don't understand why the whole rigamarole when they could
have just billed us for the interest on the amount due and
left the amount applied alone. I guess this way they
guarantee they've got their money for the interest (we paid
the additional tax with the amended return) and just adjust
2002's refund.

I sent feedback about the form design at DC's website and
actually got a phone call thanking me for my feedback. The
guy agreed that there is a problem with amending returns and
was surprised it hadn't been discovered in the review
process. Hopefully this means they will actually do
something about it.

Well, at this point I'd wait for him to get back to you. I
found it impossible to fix a problem with DC over the phone.
I finally gave up, bundled up all my papers, and spent 3
hours at their office. YMMV.

Default Amending DC individual tax return (D-40)

What a mess. We amended a client's 2001 return and the software
(UltraTax) asked for the amount of the original refund. So I input
the original refund and it added that amount to the tax. This makes
everything math out correctly, but it gets things royally screwed up
at the DC Tax Department. Where my client should only owe about
$1,500, DC is claiming he owes about $14,000!

For starters, they tell me we should not have added the original
refund amount to the corrected tax. That messed up things in their
computer system. It would be nice if DC included instructions for
filing amended returns. They said I should have ignored the refund
and just filed the return with a new refund amount and they would have
done the math to figure the amount due (oh yeah, we were reporting
additional income).

Has anybody else run into this problem before? I've been having a
devil of a time getting them to correct this. The first operator I
spoke to had no recollection of our half hour conversation when I
called back the next day. The new guy and I finally came to an
understanding and he actually made notes in the file. According to
him, filing a corrected return might not help matters. He needs to
get a technician to make the corrections.
