Send in the paper return, Don't expect the refund, but you
should not be penalized either if a refund was owed.

You're not in deep doo--doo. AS you mentioned
you had a refund--but I'm afrai that appears
lost. The missing 8453-OL should not invalidate
the filing. If you have the Declaration Control
Number (Confirmation number) from the original
submssiion, you might be able to get the IRS
to acknowledge timely filing and be able to
get your 1996 refund.

Seriously, just deal with this, and rather than be
worried about not sending in the 8453-OL, your
tone should be "where is my refund for 1996?"

I have recently (in the process of a background
investigation for a govt job) discovered that the IRS thinks
I never filed taxes for 1996.

Looking back at my records, it looks like I used Intuit to
create and electronically transmit form 8453-OL, but
probably forgot to check for confirmation and mail it (this
was around the time our first child was born, I wouldn't be
surprised). I am basing this on the fact that I still seem
to have the original W-2 in the manilla folder labeled
"1996", and that the instructions state "mail this form
after receiving confirmation". I show that I was owed a
refund, but don't think I have banking records going back to
1996 to check whether I ever received the transfer for it.

The question is - what am I to do? Is this a pretty common
thing, or am I in deep trouble now? Is there some record at
the IRS of an electronic transmission that they should be
able to locate? What happens internally when they receive an
electronic transmission of the form - do they wait for the
hardcopy, or just process it?
