I would caption the motion, "Motion To Redesignate
Proceeding from Regular Tax Case To Small Tax Case." You
should cite TCR 171(c) as the authority under which the
motion is made. As usual, you should state your support
for the motion.

Did you check the Tax Court rules to see if there's a rule
that addresses this? The current version of the rules is on
the Court's web site. (www.ustaxcourt.gov)

Default US Tax Court--Simple Motion?

Case is on regular calendar for October. Clients cannot
afford extra costs (i.e., briefs, formal rules of evidence,
increased Stip. burden, etc.) of regular trial, but case is
presentable, simply needs to be switched to an "S"
calendar. Still may be settled, but I do not want to wait
too much longer to get it off regular Tax Court calendar.

Anyone have sample Motion to accomplish this, or at least
the "Name" of Motion to be filed? (to get it from a regular
calendar to an "S" calendar)
