That one may be, but it sounds like a close cousin to the
mess in DC, where food for home use is tax exempt, but food
in restaurants is taxed at one rate, and "snack" foods at
another. It can lead to some fun discussions, though. For
example, a checker wanted to charge me snack tax on
unsweetened chocolate, since the box said "for candy...." I
gave her a bite. She didn't charge me.

That sounds like an urban legend, but you can go to
taxsites.com and link to the CA Franchise board and
research it on your own.
