No, it made the unreasonable 30% set-asides that Richmond
was using illegal. Set-asides are still very common in
municipal contracting.

This can be even more fun in community property states where
spouses are ~presumed~ to own the business 50/50%. A female
client of mine once wished to bid on some city projects. She had
to furnish an affidavit from her husband stating that he had no
interest in the business other than community property rights,
exercised no management control, etc., etc.

But, agreed, this is not a tax issue...

No tax advantage. It's mainly of interest to companies that
want to compete for set-aside contracts; particularly in
government contracting, there are often set-aside
percentages for woman-owned or minority-owned busiensses, or
requirements that prime contractors award set-aside
subcontracts.

The OP's proposition, though, would be a fraud. For the
company to qualify as woman-owned, she must actually manage
the company; and if she owns 51%, she must be seen as
exercising her majority ownership.

But it still has nothing to do with taxes.

My wife and I run a business at 50% each of ownership.
If we change our ownership to show her owning 51%, is
this all it takes to make us qualify as a woman-owned
business?
