If you are on work visa in USA you are a resident alien and not a Non-
Resident Alien. Dont confuse resident alien with green card. You can
do any kind of passive investing within the law if you are a resident
alien meaning you reside in US and have a lawful job.

Same applies for stock investing, IRA, roth-IRA etc. To be extra
certain you can contact the broker through whom you plan to get 529.

Default Can a non-resident alien invest in a 529 plan

Hi:
I am in U.S on a work visa and would like to invest for my child's
college through ESA & 529 plan. I researched a few 529 plans (florida,
nevada, georgia) but the eligibility in them is for U.S citizens or
resident aliens. I understand that my status is "non-resident alien"
so I can't participate in those. Can someone confirm this? And are
there any states that do allow ppl in my status to participate in 529
plans?
