Yes, you put this in your will.

I highly recommend reading a book on estate planning and talking to an
attorney instead of asking random people on the net for advice. Reading
the book first will give you an overview of the whole process and what
decisions you have to make, and the attorney will draw up the appropriate
paperwork.

Thank you very much.
Is there a way to leave the furnishings in my house to someone?

Is there a way to leave the house to someone so they get the proceeds
when it is sold (still have loan on it but there is some equity in it
of course)?

Thanks for any ideas?

Yes. The beneficiary on an account gets the money, regardless of the
will (as it has been explained to me). I set up the POD people
(Payable On Death) to reflect the distribution in my will. Titling
assets is very important. Titled assets such as bank accounts and
houses are the important ones. A Trust doesn't do any good if you
don't correctly title assets into it. Marriage and divorce has a way
of making these things out of date. Anyone who has been putting off
updating their trust should make a schedule to do it and stick to it.

This sounds dicey. If you leave money to a person, it's their money.
Don't expect them to do anything further with it. Just leave the
money to the people you want to get it.

Either way could be made to work, especially for small amounts of
money. Doing it correctly is the important thing. This may be the
time to spend a few bucks on an attorney and have a proper will set up.
Just be clear on what you want done before you go in. If this
requries a trust, I'm sure the attorney will tell you.

Question: If you have a beneficiary set up on your checking, 401k
accounts, etc..-don't they take precedence over anything said in a will
as to distribution?

Or if you leave the money to a person who is also an executor of the
will and in the will state what the disbursement should be-will that
work and avoid complicated situations?

Or would I need to set up a Trust? (not talking about a lot of money
here. Still have 25 years on my house payment).
