I'd go to both bank and collection agency, with all my documentation, and with an attitude of "bygones" so you can get what you want, explain the situation with enormous (bite your tongue, if necessary) courtesy, and make them tell you why they won't clear your credit record. If you paid off every cent, there's nothing more for them to collect. Document in writing as much as possible what transpires. Something does not add up here. I worked with the credit bureaus a couple of years ago after a small but not insignificant case of ID theft, resulting in billing to me without my knowledge by some yahoo. Lotta red tape and a bit of a runaround now and then, but the credit bureaus were overall pretty good. There was a fairly well-defined process to clearing up disputes. Fill out all the paperwork to which they direct you, certify, submit it, and the bureaus review it pretty quickly--couple of months, tops. OTOH, the (phone) company that had let (AFAIC) my ID be stolen had a history of this problem, and that probably helped clear my name. |

From: dontdamnme_79[at]yahoo.com I had a little problem with a checking account that went overdrawn due to some tricky application of NSF fees by the bank that finally resulted in a few hundred dollars and I said to hell with it. Anyhow, I was disputing these items with the bank and they never called me back after saying they would. Time elapsed and eventually the bank turned it over to a collector before I could get the issue resolved. Well, anytime I tried to contact the bank after this, I was told "I'm sorry, your account was charged off and we don't have any info anymore, you need to call the collection agency". The bank acknowledged the balance and the fact that it was with a collector, even giving me their phone #. In essence, they told me I was screwed, pay up. I eventually paid the collection, because I needed to open a checking account elsewhere. However, this did not change the fact that I was disputing the item with the bank and that it should have never gone to collections. My question is: should I put in a dispute form with the credit bureaus, stating this account was in dispute and should be removed from my report? What are the legal ramifications? I trust that dealing with the bank or the collection agency is just a waste of time at this point, especially since I have paid off the debt. Any advice would be helpful. Thanks!
