However, a relatively recent development in the deswign of 401k> Yes, and most (all?) do. [It might even be a requirement > of the tax code.] plans is the growing additoions of either self-directed brokerage account opeions and/or "mutual fund windows" (the latter allowing folks to invest in funds only through a mutual fund supermarket). Not all employers, by any stgretch, have offered these options, but a recent survey showed the majority either have - or are *considering* adding them. Talk to your employer. (For more info, google on "401k" and "mutual fund window") -- Plain Bread alone for e-mail, thanks. The rest gets trashed. Every now and then I encounter a plan that lets active employees rollout of a 401k, but usually not. Such exceptions are typically related to safe-harbor provisions where older participants are allowed to roll out for investment reasons. As you have already been told, check with your employer. If you doubt their response, ask for the plan document - it will answer your question. - quote - > Can my employer legally charge a penalty?
Only if provided in the plan document. Having said that, it would beunusual to see an employer-charged cost to roll out. More likely if there is an exit cost it will be investment related like surrender charges or sales loads. - quote - > Any other problems with doing this?
Without my crystal ball (broken now for over 30 years) that questionis too general for me to tackle. <grin -HW "Skip" Weldon Columbia, SC |

| Look in the plan summary for partial in-service rollover. If it is allowed than you can. Otherwise if the returns are bad be sure to point it out to the people in charge. They have a fiduciary responsibility to be sure the plan is reaching its goal. If they don't care or tell you it is not there problem, let the Department of Labor know. "T.C. | My current employer has a 401k plan which I have participated in for the past 3 years. I am no longer comfortable with the quality and diversity of the investment choices in this plan, not to mention the poor rates of return. As such, I would like to do a direct rollover of 100% of my vested monies into a traditional IRA in order in order to increase my investment choices. I am not planning to terminate my participation in the plan so the I can continue to receive my employer's contribution. I just don't feel comfortable having all my retirement savings there. The questions I have are: Can my employer block such a transfer? Can my employer legally charge a penalty? Any other problems with doing this? Thank you |
