Call the plan provider and ask them. (Fidelity, Vanguard, whoever)

Default Firm won't transfer 401k until end of plan year

When I inquired about transfering my 401k to an IRA, my former
employer told me that "all distributions will be made as soon as
administratively feasible following the end of the plan year following
termination of employment". The plan year ends in December, so that
means I can't get at my assents until Jan 06. Is this leagl? Can they
do this?
