| Go to the County Courthouse and file a small claims lawsuit against them. This may be the only way they will respond to you. Do a little research at the courthouse and see if they have other lawsuits against them. Also, be persistent with the CA mortgage licensing agency. Write them a letter and send it Certified with receipt. Visit them about a week later and demand (nicely) to speak with someone about your situation and formal complaint. - quote - > From the County website:
no later than 30 minutes prior to closing. Please check Court hoursIf you are filing a new Small Claims case, please arrive at the court below. You may file a Small Claims action if the total amount of damages is $5,000, or less. You may only file two claims that exceed $2,500 in a calendar year in the state of California. This is the proper court to file your lawsuit , if one of the following statements are true: * A defendant lives in this judicial district, or if the defendant is a business that has its principal place of business in this judicial district. * A person was injured or personal property was damaged in this judicial district. * A defendant signed or entered into a contract in this judicial district, a defendant lived in this judicial district when the contract was entered into, a contract or obligation was to be performed in this judicial district, or if the defendant is a corporation, the contract was breached in this judicial district. ultimangel[at]hotmail.com (Nardia Grimlo) wrote in message news:<b191e9d7.0309251622.1494d24b[at]posting.google.com> ... - quote - > For your information, this company offers very low rates on a home > mortgage. In retrospect, this should have been a tip-off. You never send> fees, escrow and interest payment of 4200$ via wire from our bank. > Then we didn't hear from them so we started calling our loan agent > Erica Garcia asking "is everything OK". No answer to our messages. So > then we called customer service and left a message. No response. this money to the lender. All the lender should ever ask for in advance is money for your credit report, about $50, in case you lied about your credit, and perhaps the appraisal fee, which should be no more than $350. Everything else should be paid to the escrow agent at closing time. If someone asks for money up front rather than waiting for the closing, that is your tip-off that it is a scam. -john- -- ================================================== ================== John A. | For your information, this company offers very low rates on a home mortgage. Only problem is after you fill out all the paper work, and send them your fees, escrow and interest payment, not only do they not fund your loan but they keep your money. In early July of 2003 I locked in a low rate with instafi.com 1-800-INSTAFI (467-8234) 2600 Michelson Drive Suite 300 Irvine CA 92612 info[at]instafi.com We filled out the paperwork as requested with the notary, paid the fees, escrow and interest payment of 4200$ via wire from our bank. Then we didn't hear from them so we started calling our loan agent Erica Garcia asking "is everything OK". No answer to our messages. So then we called customer service and left a message. No response. We did this about twice a week for 3 weeks and then almost daily for another 2 weeks when they suddenly called us and said "Gee, we are sorry, but it's been more than 30 days and your loan lock is no longer any good". They then tried to pressure my wife into getting a new loan with much higher fees, points and a higher loan rate. They told her "you have to hurry before rates go up". We told them we wanted our money back and we didn't want to do business with them. We've tried calling the head of customer service John Valdez many times with no success. We've also tried calling the CEO Sean Roberts (who appears on their TV commercials) to no success. No one ever answers any of the kind and patient messages we have left for them. Eight weeks has gone by now. I call them daily. No one ever answers the phone except for these phone operator type folks UNLESS you call, lie, and say you want a new loan, then they answer. One employee told me that instafi.com has done this to thousands of people. if that is true I am concerned that they are going to just suddenly disappear one day and take everyone's money with them. I told the police and the DA's office, and they said "it's a civil matter". I called and wrote the state dept. that licences Instafi.com as a lender, and they don't answer their phones or respond either. If you want to lose your hard earned money, go ahead, deal with Instafi.com. If you want to help stop these people, give them a call for me. Tell them we don't appreciate the way they treat people. |
