I think the NYT terms of use, which you agree to when you access the
site, prohibit this kind of distribution, but that's their axe to grind.
More to the point though - I think a usenet post should have more than
just an entire quoted article, to help kick off some discussion. Esp
when it's a pretty general article.

Newsbase4 sounds like a bot (perhaps related to the infamous
"allyourbase"?)... but if not how about at least one comment, anything
really..."these guys are nuts" or "Dorothy Mulvi is my great aunt".

Speaking as a former rock musician and BMI registered
songwriter/publisher, I once (30 years ago, or so) had a
first-hand working knowledge of copyright law. While I can't say
that my knowledge is current, I can say that your interpretation
and policy appears to be "spot on" as near as I can tell.

Short quotations (with appropriate attribution) are probably
acceptable, verbatim reproduction of an entire work is not.

I've read over the posts about the New Times article that
made it online to the group and decided we are going to need
some guidelines here.

Basically, like it or not, we have to abide by the various
copyright rules. As the moderators are based in the United
States, we certainly have to worry about U.S. rules even if
the original poster (who in this case appears to have posted
from the United Kingdom) does not. Generally, though, I
would prefer not to get into a jurisdictional argument in
the first place.

For that reason, it will generally be the policy that we
will not accept posts that consist, in full or part, of the
full text of an article by anyone *except* the original
author and copyright holder (and we may not post those
either--I don't really want to figure out *who* owns the
copyright). Links to websites *are* acceptable.

Now, I realize the New York Times requires registration to
view the articles, and that the articles are then available
for free. However, under U.S. law, it certainly appears to
be their right to determine how people will be able to read
their articles (including requiring purchase of a paper).
So if they impose the condition of registering to read their
article, this newsgroup cannot be used as a "roundabout" way
to get around that requirement.

Clearly, you are allowed to summarize the information and
direct readers to the article. As well, short quotations
from the article would qualify under the "fair use" doctrine
and would be allowed.
